UBTECH (hereinafter also referred to as "we", "us" or "our") is committed to respecting your privacy. This Privacy Notice explains who we are and how we collect, share, and use your personal information, and how you can protect your privacy. This Privacy Notice applies to our collection of your personal information through our Jimu modular smart robot and Jimu app ("Jimu app", "Jimu Robot app") and your use of our services (the "Services").

What Products and Services Do We Offer?
Founded in 2012, UBTECH is a global hi-tech enterprise that specializes in the research and development of artificial intelligence and humanoid robots, as well as the development and application of app platforms and product sales. UBTECH and Tsinghua University have set up a joint laboratory for smart service robots. UBTECH is actively building an ecosystem of hardware, software, services, and content for the robot ecosystem. UBTECH strives to become a global leader in artificial intelligence and humanoid robots and is committed to realizing the dream of bringing robots into thousands of homes. Our Jimu modular smart robot is used for STEAM education and provides our users with features such as model building, logic programming, and robot control, as well as courses that allow our users to create their own robots. What Personal Information Do We Collect and Why?
The personal information that we may collect about you broadly falls into the following categories:
We use this personal information to facilitate the use of our products. Generally, the personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information.

However, if permitted by applicable local data protection laws, we may also use your personal information for purposes other than those we have explained to you (such as for public benefit, for scientific or historical research, or statistics purposes).
Who Does UBTECH Share My Personal Information with?
We may disclose personal information about you to the following types of recipients:
  • To our group companies, third-party services providers, and partners who provide data processing services to us (for example, to support our speech recognition and semantic understanding), or who otherwise process personal information for purposes that are described in this Privacy Notice or notified to you when we collect your personal information.
  • To any competent law enforcement body, regulatory body, government agency, court, or other third parties where we believe disclosure is necessary (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person;
  • To an actual or potential buyer (and its agents and advisers) in connection with any actual or proposed purchase, merger or acquisition of any part of our business, provided that we inform the buyer it must use your personal information only for the purposes disclosed in this Privacy Notice;

Legal Basis for Processing Personal Information (for Visitors and Users from the EEA only)
If you are a visitor or user from the European Economic Area (EEA), our legal basis for collecting and using the personal information described above will depend on the personal information concerned and the specific context in which we collect it.
However, we will normally collect personal information from you, only (i) where we need the personal information to perform a contract with you, (ii) where the processing is in our legitimate interests and not overridden by your rights, or (iii) where we have your consent to do so. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.
If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information).
If we collect and use your personal information in reliance on our legitimate interests (or those of any third party), this interest will normally be to operate our company and to communicate with you as necessary to provide our services to you; and/or for our legitimate commercial interest, for instance, when responding to your queries, improving our products, undertaking marketing, or for the purposes of detecting or preventing illegal activities. How Does UBTECH Protect My Personal Information
We use appropriate technical means and organizational measures to protect the personal information we collect from you. The measures we take are designed to protect your personal information from the risks associated with our processing of your personal information. We take measures such as Secure Socket Layer (SSL) encryption to ensure the secure transmission of data about you from your browser to our network system.
Your personal information will all be stored on a secure server and protected within controlled facilities. We classify data about you according to its importance and sensitivity, and ensure your personal information is secured at the highest security level. We ensure that our employees and third-party service providers who access your personal information to help provide products and services to you assume strict contractual confidentiality obligations and will be disciplined or terminated if they fail to perform these obligations. We also implement access control specially designed for cloud-based data storage. We regularly review our practices regarding the collection, storage, and processing of your personal information, including physical security measures, in order to prevent any unauthorized access and use.
We will take all feasible measures to protect your personal information. However, you should be aware that the use of the Internet is not always secure. Therefore, we cannot guarantee the security or integrity of any personal information when transmitted over the Internet.
We will promptly notify appropriate regulatory agencies of any leakage of personal data, and in some special circumstances, notify the data subject in order to comply with applicable laws, including the data protection laws in your jurisdiction.

  • You can play a role in protecting your personal information by avoiding disclosing your login password or account information to anyone (unless such person is duly authorized by you). Whenever you sign in to the Jimu app or any of other UBTECH products as a UBTECH account user, especially on another person's device or a public Internet terminal, you should always sign out at the end of your session.
  • UBTECH is not liable for any security risks arising out of any third-party access to your personal information as a result of your failure to protect the privacy of your personal information. Notwithstanding the foregoing, you must promptly notify us of any unauthorized use of your account by any other Internet users or of any other security risks.
International Data Transfers
Your personal information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different from the laws of your country (and, in some cases, may not be as protective).
Specifically, we and our third-party service providers and partners operate around the world. This means that when we collect your personal information, we may process it in any of these countries.
However, we have taken appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Notice. These include implementing an intra-group agreement incorporating the European Commission's Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect personal information they process from the EEA in accordance with European Union data protection law.

Data Storage
We retain personal information we collect from you where we have an ongoing legitimate business need to do so.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (e.g., because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
Your Data Protection Rights
During the use of our products or services, you have the right to access, modify, transfer or delete the data about you.
You have the right to request access to and/or correction of any personal information that we hold about you. When you update your personal information, you will be asked to verify your identity before we proceed with your request. Once we obtain sufficient information to accommodate your request for access to or correction of your personal information, we will proceed to respond to your request within the time frame set out under your applicable data protection laws.

If you are a Europe Union user under General Data Protection Regulation (GDPR), you have the right to obtain from us the erasure of your personal information. We will consider the grounds regarding your erasure request and take reasonable steps, including technical measures, if the grounds apply to GDPR.
If you are a European Union user under GDPR, you have the right to obtain from us the restriction of processing your personal information. We will consider the grounds regarding your restriction request. If the grounds apply to GDPR, we will only process your personal information under applicable circumstances in GDPR and inform you before the restriction of processing is lifted.
If you are a European Union user under GDPR, you have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you.
If you are a European Union user under GDPR, you have the right to receive your personal information in a structured, commonly used format, and transmit the information to another data controller.
We provide examples of ways UBTECH makes available for you to choose to restrict the collection, use, disclosure or processing of your personal information and control your privacy settings:
Log in or out of your UBTECH Account;
Delete any information stored in your account;
Cancel your account from the app and remove all of your personal data; or
Toggle on or off other services and functionalities that deal with your sensitive or personal information such as your location information.

Children's Privacy Policy
Jimu is committed to protecting the privacy of the children who use our products. The Children's Online Privacy Protection Act requires children under 13 to use our products under the supervision of their parent or guardian. The EU General Data Protection Regulation (GDPR) contains special provisions for the protection of children's personal data which allow member states to set the age threshold for children anywhere between 13 to 16. We call children under 13 in the United States and children under the age of 13 to 16 in the European Union children. Below are described our practices regarding the collection and disclosure of information about them and our practices for obtaining parental consent.
Signing up
It is recommended that the account is registered under the guidance of a school so that it can be provided to children. In the sign-up process, children will be asked to enter their date of birth in order to ensure that their age meets legal requirements. They will also be required to provide the email address of their parent, teacher, or guardian so that the adult can create a username and password for them. We strongly recommend that adults should not provide any personal information about their children in their username, and we will not request information that is not required for a log-in.

Content Generated by children
Children are allowed to create content and save it. Examples of created content that may include personal information are programs, images, videos, comments and posts. It is possible that the parent rejects the content generated by the child, and decides to keep it private between them both. Otherwise, it will be sent to Jimu administrators of the Jimu Robot platform, who can moderate it before it is publicly posted. Jimu administrators have the sole right to reject any content that is inappropriate for the following reasons:
Sexual content that contains graphic sexual activity or nudity.
Aggressive content that promotes violence causing physical harm to humans and/or animals.
Hateful or abusive content that incites hatred against protected groups, minorities or even individual people.
Children abuse content that includes sexual, predatory or abusive communications towards minors.
Spam or misleading content that is massively posted or otherwise misleading in nature.
Intellectually dishonest content that violates Jimus' agreements such as Jimu's intellectual property rights and/or Jimu's privacy policy and terms of use.
About Verifiable Instructor's Consent
In the event Jimu wishes to collect personal information from a child, the Children Online Privacy Policy Act (thereafter “COPPA”) requires that we first seek a parent or guardian’s consent by email. In the email we will explain what information we are collecting and how we plan to use it or revoke it. We shall completely delete the instructor’s contact information if we do not receive parental consent within a reasonable time.
In the case of school-based activities, COPPA allows teachers and school administrators to act in lieu of parents or guardians unless they notify these latter of such activity in order to obtain their consent. Schools should in general always notify parents about these activities.
Other collection of information about children
In addition to publishing personal information about children (after ensuring that consent has been obtained from their parent), we may also share or disclose the personal information we collect from children under the following limited circumstances:
  • We may share with the Bulletin Board Solutions Team the information required for providing us with functional support; or
  • If required by law (such as to respond to a court order or summons), we may disclose personal information. To the extent permitted by applicable law, we may also disclose personal information about children in order to respond to the requirements of law enforcement or public agencies, or if we believe that disclosing information may prevent abetting a crime so as to protect the security or integrity of our platform.
Parent or guardian's choices and control
The parent, teacher, or guardian of children may change the password, username, or avatar of children, or delete their account to ban children from accessing the Jimu robot platform. Deleting an account will immediately ban any posted content from being displayed. If you have any difficulty in editing or removing children information, please seek help by sending an email at support@ubtrobot.com.
Updates to This Privacy Notice
We may update this Privacy Notice from time to time in response to changing legal, technical or business developments. When we update this Privacy Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make. We will obtain your consent to any substantial amendments to this Privacy Notice if and where this is required by applicable data protection laws.
